    Terms of Service

    Introduction

    These Terms of Service ("Terms") govern your use of Sumyfi (the "App"), a financial wellness application provided by Sumyfi ("we", "our", "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

    Eligibility

    To use the App, you must:

    • Be at least 18 years old (or the age of majority in your jurisdiction).
    • Have the legal capacity to enter into a binding agreement.
    • Use the App only for lawful purposes and in accordance with these Terms.

    By using the App, you represent and warrant that you meet these eligibility requirements.

    Description of Services

    The App provides tools to help you understand and manage your finances, including features such as budgeting, goals, transaction insights, and account aggregation.

    • Connecting eligible bank and financial accounts through trusted third-party providers.
    • Displaying balances, transactions, and other financial information made available to us.
    • Providing visualizations, alerts, and other insights about your spending and saving.

    We may add, remove, or modify features over time to improve the App.

    Account Registration

    To access certain features, you may be required to create an account and provide accurate, current, and complete information.

    • Keep your login credentials confidential and do not share them with others.
    • Promptly update your information if it changes.
    • You are responsible for all activity that occurs under your account.

    If we suspect unauthorized use or a breach of security, we may suspend or terminate your access to protect you and the platform.

    User Conduct

    You agree not to use the App in any way that:

    • Violates any applicable law or regulation.
    • Infringes the rights of others, including privacy, intellectual property, or other rights.
    • Attempts to gain unauthorized access to the App, other accounts, or our systems.
    • Introduces malware, viruses, or other harmful code.
    • Misuses the App for fraudulent, deceptive, or abusive purposes.

    Financial Transactions

    The App may allow you to view or initiate certain financial transactions through your connected accounts. Sumyfi is not a bank, credit union, or financial advisor, and does not hold or control your funds.

    • Transactions are processed by your financial institution or third-party service providers.
    • You are responsible for reviewing and confirming any transactions before they are submitted.
    • We are not responsible for errors, fees, or losses arising from transactions processed by others.

    Third-Party Services

    We may integrate with third-party services (such as bank connectivity providers, cloud services, and analytics tools) to operate the App.

    Your use of those services may be subject to separate terms and privacy policies. We do not control or take responsibility for the availability, accuracy, or security practices of third-party services.

    Where you choose to link financial accounts, you may be required to consent directly to the provider (for example, Plaid) that facilitates the secure connection to your institution.

    Fees & Charges

    Some features of the App may be offered for free, while others may be subject to fees or subscription charges.

    If we introduce or change fees, we will provide notice in the App or through another reasonable channel. By continuing to use fee-based features after changes take effect, you agree to the updated pricing.

    Privacy & Data Security

    Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

    We implement security measures designed to protect your data, but no system is completely secure. You are responsible for safeguarding your devices and login credentials. For more details, please review our Privacy Policy.

    Intellectual Property

    The App, including its design, text, graphics, logos, and underlying software, is owned or licensed by Sumyfi and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

    Disclaimers

    The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

    Any information or insights provided by the App are for informational purposes only and do not constitute financial, legal, or tax advice. You are responsible for your own decisions and should consult a qualified professional as needed.

    Limitation of Liability

    To the fullest extent permitted by law, Sumyfi and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App.

    Our total liability for any claims arising out of or relating to the App or these Terms will not exceed the amount you have paid to us (if any) for use of the App in the twelve (12) months preceding the event giving rise to the claim.

    Indemnification

    You agree to indemnify, defend, and hold harmless Sumyfi and its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your infringement of any rights of another person or entity.

    Suspension & Termination

    We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if we decide to discontinue the App.

    You may stop using the App at any time. Certain provisions of these Terms will continue to apply after termination, including those relating to intellectual property, disclaimers, limitation of liability, and indemnification.

    Governing Law & Dispute Resolution

    These Terms are governed by the laws of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

    Before initiating formal proceedings, we encourage you to contact us so that we can try to resolve the issue informally.

    Changes to These Terms

    We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where appropriate, provide notice within the App or by other reasonable means. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

    Acceptance of Terms

    By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the App.
